Huge Florida Monkey Farm Sues Competitor Over Land Purchase

Florida Monkey Farm Lawsuit Reveals Allegations of "Feces-Filled Canals"

(LaBelle, FL) -- A civil lawsuit ("BC US vs. Panther Tracts") filed in Twentieth Judicial Circuit Court has raised disturbing allegations of water pollution from one of the largest monkey farms in the country.

BC US is the U.S. arm of Mauritius-based Bioculture Group, and operates a facility in southern Hendry County for the quarantine, holding and breeding of monkeys imported from the island nation. BC US sells monkeys for use in research and testing.

The lawsuit centers on BC US' desire to purchase property that it has been leasing since 2012. BC US alleges that the property owner, Panther Tracts LLC, is refusing to honor a purchase option in the lease agreement. In response, Panther Tracts argues that BC US is in default of the lease, "by violating environmental laws and improperly disposing of animal waste."

BC US holds close to 2,500 monkeys in dozens of outdoor pens at the property, located on the northern boundary of the Big Cypress National Preserve.

Florida and Hendry County is thought have the largest monkey breeding facilities in the U.S.

On July 8, 2024, Panther Tracts filed a motion for temporary injunction to stop BC US from "unpermitted disposal of animal waste (monkey feces) at the leased premises." The motion alleges, "BC US is not disposing of massive amounts of animal feces by the strict land application required by the ERP [Environmental Resource Permit, issued by the South Florida Water Management District]." The motion describes canals, "filled with floating solid animal feces, algae, and scum resulting from overloading of nutrients."

"The importation and breeding of monkeys for use in laboratory experimentation causes horrible suffering. The thousands of monkeys who are closely confined in concrete and wire enclosures in Hendry County's monkey farms produce enormous quantities of urine and feces and wastewater," said Nanci Alexander, President, Animal Rights Foundation of Florida (ARFF). "This lawsuit reveals how the monkey farms are a threat to the Big Cypress National Preserve, and to the water resources that are essential to a healthy ecosystem and the clean water that Florida's people, animals and plants depend upon."

Until recently, Panther Tracts was an independent corporation that also leased neighboring property to Worldwide Primates, another supplier of monkeys for use in experimentation. In 2023, Worldwide Primates acquired ownership of Panther Tracts, in effect making one of BC US' competitors also its landlord. Worldwide Primates confines 4,000 monkeys at the Hendry County property.

Florida Keys' Watercolor Kapers By Bob Kranich

Florida Keys’ Watercolor Kapers”
by Bob Kranich

Robert’s Best, (Part 12, Excerpt 97)

This is a new story. Robert’s Best is a sail boat. Grandfather Roberts is going to sail it on the Intercostal waterway from Texas to Key West, Florida. That will be an adventure. Then his grandchildren and their parents will come to Key West on a visit. There will be a lot of funny happenings until the criminals from a previous story get into action. A side note is that a 1935 antique Chris-Craft Model 557 Cabin Cruiser is going to play an important part in the rest of the story. Grandfather Roberts has arrived in Key West. He has meet Honest Dave and had a tour of his Chris-Craft. Both He and Dave are looking around Key West for a house for Grandfather Roberts. They have just hired a carriage and driver and the driver found Grandfather Roberts a house on the Atlantic to purchase.

Roberts’ Best

He and Bessie, clop, clopped off down the street.

“Tom, I know it’s been busy, but if you're hungry, I’ll buy. You need to see and eat at Sloppy Joes. I don’t drink, and I’m guessing you don’t either. However, they do serve a great steak and fries!”

“Dave, I’m for that. Now that I’ve got my house, thanks to you and Franklin, I’m rested, not a care in the world. How do we get there?”

“It’s only a couple of blocks from here, on Duval and Green. We can walk.”

Sloppy Joe’s was a one-story structure, right on the corner. In fact, it was kind of an open air establishment. It had many openings with folding double doors. There were five, six-foot wide openings right out onto the sidewalk and street. It was decorated inside with all kinds of paraphernalia, stuffed game fish, rods and reels, pirate stuff, boat hardware, and signed photos of all the famous people who had visited.
We went in and took a table between two doors off Green Street. “It’s not very classy, but it’s the place to visit when you’re in Key West. Of course you know, Tom, that Joe and Hemingway were just like this,” as he crossed two fingers, “real deep sea fishing and carousing buddies in the 1930’s.”

“Is that right, Dave? I guess now that I’m an islander I will have to read up on the history. Sounds like you’re on top of it!”

“Can I help you, Sirs?” the waitress asked.

“Yep, your steak and fries, please,” Dave answered.

“I’ll take the same,” I added.

“Drinks, Sirs?”

Dave put in, “We’re teetotalers, we’ll take some sarsaparilla.”

“I only have Ginger Ale,” she answered.

“Yep,” Dave and I both replied.

“Well, Dave tell me about your Homestead antique business.”

“Tom, it’s like this, I’ve been interested in and collecting antiques since as long as I can remember. Never could pass up a yard sale or an antique shop. I’ve got a couple of consignment locations, you know, antique malls. Also I’m set up in an old barn on the edge of the Everglades. That is my center of operations, furniture refinishing and tons of antiques I’ve bought over the years. I fixed me up a little suite in that barn, and I can hold up there and fix antiques to my heart’s content. I also have a few other endeavors, such as flea markets where I sell authentic treasure maps to the tourists. Well, that was a mouthful. How about you, Tom?”

“Oil engineering. I started right out of college with a West Texas wildcat drilling company. They hit it big, crude oil, brought in a couple of wells right after I joined. I bought into the company, and we hit it big a couple more times. By age fifty-five I had a good share, so I sold out and then invested some in a few other companies. They also made it good. I guess I was blessed by the Good Lord. I’m not a millionaire, but I’m set up OK. I’ve been tinkering around ever since.”

“I’ve got a great son, daughter-in-law, and two grandchildren. Wife’s with the Lord.”

“Tom, I guess we have to take the good with the bad. Here comes our food. I’m famished!”

While Dave and I talked and dined, we didn’t see the two men who came in one of the far door openings. They eased up to and sat at the bar.

“What’re you guys drinking?” the bartender inquired.

“We’ll take a couple of Sloppy Joe Specials.”

They were dressed a little sporty, though not so wild they stood out, because in Key West, anything goes. Hawaiian shirts peeked out from under their light-colored sport jackets. Tropical dress pants and leather sport dress shoes finished their attire.

One was tall and thin, the other, kind of average height but stocky and with a scar across his forehead. Both had black hair and were tanned. The tall one had a faint moustache.

“There they are, Vince, the two guys I told you about. The one with the long side burns and pony tail has got that old Chris-Craft. He thinks it’s a cruiser, it’s just an old tub! Ha, he should see ours, then he'll know just what a cruiser really is!”

“What about the other guy?”

“He’s got a small sailboat, one mast, about twenty-eight to thirty feet. Heard that he sailed down from the Houston area.”

“They got any dough?”

“I haven’t had any time to look into it. But it looks like the sailor may have bought a house down by the end of United Street.”

“How do you know that, Frank?”

“He and Chris-Craft rode that tourist horse and carriage down there, went in, and a realtor showed up. Course it had a For Sale sign out front. When the realtor dame came out she had some papers in her hand and was smiling.”

“Well, check ‘em out. You know, even Chris-Craft may be loaded!”

“I’m on it, Boss.”

Back at the Key West harbor on the pier: “So what’s your plan, Tom?” Dave asked.

“The realtor will naturally verify the check. So, I’m going to touch base with the owner, see if she wants to part with any furniture. I’ll live on this boat until I can move in, sooner better than later. Then I’ll complete the furnishing of the place, and see if I can talk my son into coming down for a visit. Hopefully, he will leave my grandson for a two-to-three week visit.”

“Let’s see, that will be in a month to five weeks. Tell you what, I’ll call you and come back and then we’ll tour, cruise, and sail around if you want?”

“It sounds good to me, Dave.”

Florida Driver License Changes July 31

TALLAHASSEE, Fla.- On July 31, 2024, the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) will begin implementing legislation which amends Florida Statute 322.14 (1)(a) and requires the distinguishing numbers assigned to a driver license or identification card to include at least four randomly generated numbers. This new system aims to improve security and safeguard individuals' identities.

While the license or identification card format will remain the same, a different formula utilizing randomization will now be used to determine the driver license numbers assigned to a customer. Customers renewing or replacing their license or identification cards in person or online will be issued a new number. Those applying for a first-time license or identification card will be issued a card that meets the new statutory requirements.

Once the new number has been issued, it will only change again if the customer's last name changes. Any new credential, printed report or receipt will display the newly generated driver license or identification number.

FLHSMV offers a quick, convenient way to renew your driver license or ID card online at MyDMV Portal if eligible. Customers must go into an office:
If a customer used the online convenience service on their last renewal.
If a customer is not REAL ID compliant.
If a customer wishes to update their photo.
If the customer changes their name using an original or certified court order or marriage certificate.
If a customer wishes to add or remove a designation or has a court order to update their credential.

If the customer holds a commercial driver license.
If the license has the word "TEMPORARY" printed on it.

Florida Going After Auto Dealerships In September?

Florida Attorney General Ashley Moody, Florida's chief law enforcement officer is advising Florida auto dealership owners that she may begin enforcement of Florida's 25-year old law of false advertising and unfair business practices. A letter was sent by certified mail to all Florida dealerships.

Florida dealerships, for decades not been prosecuted for advertising car and truck prices that were misleading or false. In nearly all car and truck advertisements, the price does not include added fees and equipment or state that the price depends on rebates for which all customers may not qualify.

In most cases the added fees and qualifiers are in small print at the bottom of an ad, or even on a different page of the dealer's website, making it difficult for consumers to know what the real price is, or to comparison shop among several dealers with differing fees.

Earl Stewart, Jr. of Earl Stewart Toyota in Lake Park, Florida, has for decades crusaded against dealers who advertise false and misleading prices, and have different prices for each customer..

As one of the few dealership offering "one price" to all customers. with no hidden fees, he says it's unfair for auto dealers to advertise a lower price than consumers can actually buy a vehicle for, while he advertises a real price that is higher than those artificially "low" prices of his competitors.

Stewart, on his weekly radio show, has blasted Attorney General Moody for her lack of action against dealers who have been breaking the law for decades.

Stewart says the lobby of the Florida Automobile Dealers Association (FADA) is just too powerful, and puts pressure on Moody and past Attorneys General to not interfere in their businesses.

As Moody notified dealers of possible actions against dealer misleading advertising, the FADA and President Ted Smith sent a certified letter on June 14 to all of Florida dealership owners warning of possible enforcement coming as soon as September 1, but subtly hints it may be "business as usual" as the Attorney General has always been lax to enforce the law and does not have enough personnel to prosecute dealers anyway.

Smith notes in his letter to dealers that the Office of the Attorney General (OAG), for the last 20 years has taken "a predominantly hands off approach with respect to dealer advertising" even though the 25-year old law is clear that the advertised price must include all fees and extras (excluding government taxes and fees).

Smith said the OAG has given guidance to the FADA since 2004, that even though dealer advertising is violating Florida Statute 501.976(16), no enforcement action would be taken against dealers as long as they provide a footnote below the advertised price stating that delivery fees would be added to that advertised price.

The OAG has followed that policy for the last 20 years. The OAG said they believed this would cause no harm to consumers. Apparently, the OAG will still allow this practice, but go after dealers who hide the footnoted information, or hide or don't disclose "add-ons" to the price, or show a lower advertised price by including discounts for which  not everyone can qualify.

The FADA has been holding "roadshows" for it's dealers to explain the possible new enforcement action and will hold a webinar July 17 for dealers at a cost of $199 or $375 for industry vendors.

Consumers will most likely continue to find vehicle shopping a real time consuming chore as dealerships continue to use advertising tactics against consumers trying to comparison shop, and find online true pricing.

A future trend maybe online shopping through vendors like Amazon who are planning this year to offer one manufacturer's dealership vehicle prices on their platform that presumably will be transparent and competitive. Sam's Club, Costco and AARP offer car buying services that refer consumers to pre-selected dealers with low price and price transparency that also is a help to comparison shopping although all dealerships are not included among the car buying services.

Are Florida Gas Stations Prepared For Hurricanes?

LABELLE, FL. -- Only two state have put in place laws for gas stations to cope with emergencies during hurricanes and other disasters where electric may be out for days. Florida is one and Louisiana the second.

Florida gas stations built after July 2006, must be pre-wired with a transfer switch to enable emergency power like a generator to be plugged into the stations's electrical system after a prolonged power outage. Ironically though, they are not required to have a backup generator actually on site.

According to Florida Statute 526.143, wiring must be in place to transfer the electrical load from the utility company to a generated power source no later than 36 hours after a major disaster causes a power failure.

The Florida statute is overly complicated, indicating which stations are required to comply. The Florida Legislature enacted the law in 2006, signed by then Governor Jeb Bush, after the state experienced widespread hurricane damage in 2004 and 2005.

Javier Villarreal Convicted On Weapon Charges

LaBelle (July 8, 2024) – Sentencing is scheduled for July 30, 2024, for defendant Javier Villarreal, in a case involving the defendant flashing a gun in a crowded parking lot.

The Lehigh Acres resident was convicted of Possession of a Firearm, Ammunition, or Concealed Weapon by a Convicted Felon following a two-day trial in Hendry County. The jury found the defendant had actual possession of the gun, which is an enhancement to the charge, and may result in additional penalties at sentencing.

The crime happened on June 6, 2021, at a Clewiston bar. The defendant began arguing with customers at the bar, so security staff escorted him out. He continued arguing with a group of people in the parking lot. He then got into his pick-up truck and as he drove off, he lowered his window and stuck his arm out, waving a handgun.

The Clewiston Police Department was contacted and arrived on scene. Moments later the defendant pulled back into the parking lot as customers yelled to police that he was the suspect. Police approached the vehicle and asked Villarreal to show his hands and step out. As he got out of the truck, a revolver was seen near the defendant’s leg. He was taken into custody and booked into the Hendry County Jail.

The defendant is a convicted felon and is not permitted to own a gun.

Assistant State Attorney Trevor Selph prosecuted the case.
