Defendant Wins One, Loses One This Week At Trial

LABELLE, FL. -- After being found not guilty in two prior cases against him, Timothy Eugene Alexander, Jr. was found guilty by a six-member jury Friday afternoon of resisting a correctional officer with violence and criminal mischief.

In an unusual series of events over the past 26 months as he sat in the Hendry County jail, Alexander ended up defending himself against the State Attorneys Office without the services of an attorney this week in two separate jury trials.

His court appointed attorney, Richard K. Sullivan quit last year after alleging Alexander was "threatening and aggressive" in their discussions, and told the court Alexander had "physically threatened" him "with violence."

Alexander was arrested in 2013 on a charge of arson, and was acquitted in 2015. He went to trial again this week two times before Circuit Judge James D. Sloan, 34-year old Alexander acting as his own attorney on a charge of attempted escape and then on resisting officer with violence charges.

He was found not guilty by a  six-member jury on Tuesday on the escape charge.  But despite having apparently obtained considerable legal training while in jail was not successful in defending against the resisting officers case.

During the Alexander trials this week, Judge Sloan and Assistant State Attorneys Jill Cabai and Amanda Brown gave Alexander a bit of leeway in courtroom protocols, the prosecution failing to rise when objections may have been warranted, while Judge Sloan courteously corrected Alexander's procedural errors, Alexander apologizing even though it was clear that the 34-year old defendant had a surprisingly good handle on the rules of Civil Procedure and trial decorum.

On Wednesday, his second trial began charged with resisting a correctional officer and criminal mischief. Acting as his own attorney again, he told the jury in opening statements that he believed he was a victim of "malicious prosecution," presumably because of numerous criminal charges filed against him while he was in the county jail the last two years.

He argued to the jury that while in county jail, he had chest pains and insisted on being taken to the hospital. EMS personnel showed up at the jail but determined he didn't need to be taken to the hospital at that time. He attempted to make a case that the officers used undue force to restrain him and get him back to his jail cell.

Evidence presented at the trial included a video and testimony of Alexander resisting officers' commands to go back into his cell after he was told he would not be taken to the hospital at that time. After struggling, three corrections officers eventually placed him chained to a restraint chair after tazing several times, Deputy Floyd Drummond claiming Alexander head butted him. Officer Daniel Snow had two buttons ripped from his uniform shirt by Alexander.

Alexander is a former Lee County Emergency Medical Technician and Fire Fighter and also operated a limousine service from LaBelle.

Alexander has two additional trials scheduled to begin February 1 on charges of battery on a law enforcement officer and criminal mischief. He also has an open case on charges of Sexual Battery and Assault.

Sentencing on this conviction is scheduled for March 4, 2016 at 9 a.m. at the Courthouse.

Update: On March 4, 2016 Judge Sloan sentenced Alexander to 24 months for resisting a correctional officer and 60 days for criminal mischief with credit for time served on both plus costs. He will be on state probation for 24 months. He is ordered to submit a DNA sample and within 30 day of release undergo a psychological evaluation and complete any treatment recommended.

After acting as his own attorney, Alexander has now been assigned a public defender to make an appeal of the case.

On February 4, 2016, he entered a no contest pleas to two counts of battery on a detention facility employee and received 364 day sentence on each with credit for time served plus costs. He has appealed this case as well. A separate case for battery on a law enforcement officer and criminal mischief was dropped by the State Attorney February 3, 2016.

LABELLE, FL. -- Timothy Eugene Alexander, Jr.is on trial at the Hendry County Courthouse this afternoon facing a charge of Attempted Escape after allegedly breaking out the window of a Hendry Count Jail transport vehicle on October 24, 2013 after a hospital visit.

UPDATE: On January 5, Alexander, defending himself without an attorney before Judge James Sloan and a six-member jury, was found not guilty of the escape charge. Alexander still has other criminal charges pending against him.

Jill E. Cabai, Assistant State Attorney is prosecuting Alexander today in court. Alexander is acting as his own attorney, pro se. A charge of criminal mischief against Alexander was dropped today. A jury panel was waiting at the courthouse until 1:30 pending numerous motions before Circuit Judge James D. Sloan in the morning. A six-member jury will be selected today.

Alexander, a former Lee county firefighter and party bus operator was arrested earlier in October 2013 for sexual battery on a minor and later for arson. He has been found not guilty of the arson charge.

From the Sheriff's arrest report, shortly after midnight Hendry County Inmate, Timothy E. Alexander, Jr. was transported to a nearby hospital after complaining of being in need of medical attention.

After being examined by hospital staff, Alexander's medical needs were attended to, he was then discharged and told he would be returning to the Hendry County Jail. Alexander became uncooperative and Hendry Jail personnel requested assistance from Lee County Sheriff’s Office.

Lee County Deputies arrived on scene and assisted  the Hendry County Jail deputy in escorting Alexander back to and safely securing him inside the jail transport vehicle.

Hendry County Jail personnel requested assistance from Lee County Sheriff’s Office a second time, when Alexander became unruly in the back of the HCSO transport vehicle. Alexander was shouting and began striking and punching the rear side window with his hands and kicking it with his feet, eventually breaking the window. 

Alexander then reached through the broken window attempting to open the door from the outside.

The Hendry County Transport Officer was able to safely stop the vehicle and kept Alexander from escaping.

Abner Worrell "Billy" Jordan, Jr., age 70, of LaBelle, passed away April 27, 2015 in Fort Myers.

He was born Jan. 2, 1945 in Houma, LA, to the late Abner W. and the late Merle (Posecai) Jordan, Sr. He worked as a crane operator for many years when he was younger and in later years he worked as a truck driver.

Billy leaves behind his step-mother; Sara Jordan, son; Lynn Jordan and his wife Kim of LaBelle, his grandchildren; Dustin Jordan and his wife Tiffany, Caleb Jordan and Lindsey, Taylor Jordan, great grandchildren; Jacob Jordan, Gracelynn Jordan and Jaxson Jordan. Robert Harold Bolden, Jr, age 80, of LaBelle passed away April 26, 2015 in LaBelle.

He was born Dec. 8, 1934 in Lake Wales to the late Robert Harold Bolden and the late Laura (Stokes) Bolden. He retired from I.B.E.W. Local Union 222. Robert enjoyed spending time with family and friends. He loved being outdoors hunting, fishing and barbecuing to raise money for various charities.

Former Fireman Arrested On Arson Charge

LABELLE, FL. -- On Tuesday, October 21, 2013, Hendry County Investigators assisted the State Fire Marshal’s Office in arresting 31 year old Timothy Alexander, Jr. on Arson charges, stemming from a vehicle fire in March 2013.

Alexander is a former firefighter and was recently arrested on sexual battery charges after a 16 year old female alleged he forced her to have sex on a party bus owned by Alexander.

It was reported that on March 24, 2013, Hendry County Deputies responded to a report of a vehicle that was fully engulfed in flames. After further examination of the fire, the incident was turned over to the State Fire Marshal’s Office for follow up investigation.

Timothy Alexander, Jr. is currently being held in the Hendry County Jail on $200,000.00 bond.

Two Arrested On Party Bus Sex Charges

Party Bus Owner And 2nd Man Charged With Sexual Battery

LABELLE, FL. -- On Wednesday, October 9, 2013, 31 year old Timothy Eugene Alexander, Jr., was arrested by Lee County Sheriff’s Office on a warrant from Hendry County on charges of Sexual Battery.

On the same day, Glades County Sheriff’s Office arrested a second subject, 18 year old Joshua Dale Bryan of 1000 County Road Line Trailer Park, in Glades County on charges of Sexual Battery.

On Tuesday, October 1, 2013, a 16 year old female victim along with family members,came to the Hendry County Sheriff’s Office to report she had been invited to attend a party on Timothy Alexander’s Limousine Party Bus and had been forced to have sex with Alexander and Bryan. Bryan is reportedly a cousin of Alexander.

At the end of the evening, the party bus parked at a private residence in Hendry County where the passengers got off the bus and began to socialize in the yard and in the home. After nearly everyone had left the bus, the 16 year old victim and Bryan were left on the bus alone. Alexander, who had also remained on the bus, approached the victim and had forcible sex with the 16 year old.

Investigation reportedly said drugs including meth and cocaine were in the party bus.

On Monday, October 7, 2013, Hendry County Investigators filed for and received an arrest warrant for Timothy Eugene Alexander, Jr. and Joshua Dale Bryan on charges of Sexual Battery. Alexander is currently being held in the Lee County Jail on $100,000.00 bond. Bryan is in Hendry county's jail on $100,000.00 bond.

Update: Alexander appeared before Hendry County Judge James Sloan Friday morning, and Sloan raised the bond from $100,000 to $150,000, the Judge noting Alexander's previous arrest history. At approximately 10:30 p.m. Friday night Alexander was released from jail on a $150,000 bond. As a condition of his release he is wearing a GPS tracking device. 18 year old Joshua Dale Bryan is still in custody at the Hendry County Jail.

Alexander was a firefighter with the South Trail Fire Department and reportedly was fired from the position only hours after his arrest.

Alexander in addition to his firefighting job, owns Alexander Limousines And Party Buses, Inc with an address listed at a home he owns at 450 South Davis Street in LaBelle, Florida according to state and county records. He was a co-owner of Active Fire Training, Inc. until it was dissolved in 2010.

He had been arrested September 9th, 2013 in Lee County on a charge of domestic battery by strangulation and also on April 10th, 2013 charged with aggravated assault with a deadly weapon without intent to kill.

Bryan had previously been arrested in Henry County May 7, 2013 on prowling/loitering charges, and violation of probation.

Update: On October 22 Joshua D. Bryan, 18, was released on $100,000.00 bond. At approximately 9:30 am. Bryan was released with a GPS tracking device attached to him as a special condition of his release. Additional conditions required by the courts are no contact with victim.

Julian Francis Boyce, age 83, of Immokalee, FL. passed away Tuesday, July 12, 2011 in Lehigh Acres, FL. Julian was born November 14, 1927 in Hertford, NC. He is the son of the late James Edward and the late Grace C. (Rogerson) Boyce.

He served in the Merchant Marines during World War II. He was a member of Perquimans Lodge #106 A.F. & A.M. and was also a member of the First Baptist Church of Immokalee. Julian was a Produce Broker specializing in tomatoes for many years.

He is survived by his wife: Ferrie L.(Elrod) Boyce; preceded in death by daughter Jamie Boyce, surviving daughters: Julie Gerstein and Nicki Hannoud; son: Stephen Gerstman; brothers: Ed Boyce (Inga) and Gene Boyce (Gloria); Grandchildren: Julian Gerstein, Kyle Pierce, Elliot Pierce, Justin Gerstman and Morgan Pierce; great-grandchild Lilly Pierce.

Kay Rives Phillips, age 72, of Lake Placid, passed away July 9, 2011 in Sebring. She was born Dec. 4, 1938 in Belle Glade to the late Norvin Revere Rives and the late Leona (McTaggart) Rives. Kay grew up in Belle Glade. She also lived in Lehigh Acres for many years. Kay worked for many years as Agriculture Tech III at the University of Florida Research Center in Belle Glade, FL. She was an artist, poet and author.

Paul James Cardin, age 79, of Clewiston died Saturday, July 9, 2011 at home in Clewiston. Paul was born July 15, 1931 in Englewood, TN. He is the son of the late Stanley and the late Mamie (Bradley) Cardin. He married Ruth Davenport; she preceded him in death on December 10, 2009.

He retired from Evercane Sugar Refinery in 1993 as a supervisor. He attended Calvary Baptist Church of Clewiston.

He is survived by his one daughter: Cheryl (Joe) Chevalier Brother of two sisters: Bonnie Graves, Anita Wood and one brother: Tommy Joe Cardin; he also has 4 grandchildren; 4 great-grandchildren. Granddaughter, Jennifer (Jack) Belcher; Grandson, Joe (Valerie) Chevalier, II; Grandson, Dexter (Leighanne) Chevalier; Granddaughter, Danyelle Chevalier; Great Grandson, Jackson Belcher; Great Granddaughter, Madison Ann Belcher; Great Grandson, Joe Chevalier, III; Great Grandson, Dexter Alexander Chevalier, Jr.

Barbara Lois Fulp, 75, went home to her Lord on Tuesday, July 5, 2011at 8:51pm surrounded by the love of her family and friends. Barbara was only 11 days away from her 76th birthday, ending a remarkable life.

Barbara was born in Winston-Salem, NC on July 16, 1935 to John and Lola Wright. She married Charles Allen Fulp of Winston-Salem, NC on March 13, 1955. Her husband had a career with the US Army and together they lived and traveled around the world. Barbara raised her family in Alexandria, VA and upon her husbands retirement, they relocated to LaBelle, FL for the remainder of her life.

Barbara loved reading and teaching God's word. She taught many Bible classes and led numerous Bible studies. She loved playing the piano and listening to Christian music. She was a faithful member and volunteer in her church. Barbara was a prayer warrior and spent many hours praying for others. Barbara was a loving wife and dedicated mother to both of her sons and her daughter-in-law. She also had many other "sons" and "daughters" in the Lord. She was a true and loyal friend to many people around the world.

Barbara is survived by her husband of 56 years, Charles Allen Fulp; her son Keith Allen Fulp of Winston-Salem, NC; her son Steven Charles Fulp and daughter-in-law Camilla Fulp of Lindale, TX; her grandsons Cameron David Fulp and Christian Steven Fulp of Lindale, TX; her God-daughter Elizabeth Witt Samess and husband Daniel Samess; Her sister Mary Mickey and husband Ted Mickey of Winston-Salem, NC; her brother-in-law W. Melvin Fulp and sister-in-law Betty Fulp.

Clinton Anthony Birch was born March 17, 1956, to the late Lena Campbell in Montego Bay, Jamaica West Indies. He was the only child and spent his early years with some schooling in Jamaica.

He immigrated to New York City, residing in Brooklyn and completed the rest of his schooling at Midwood High and some at New York City Community College. He pursued his passion as an artist and leather craft, creating unique works of art and clothing at his shop, Pyramid Leather in Manhattan and then in Brooklyn, N.Y.C.

In 1985 he met his life partner, Louisa McLymont. They had one child C'Leena. In 1997 he relocated to LaBelle, Florida and worked for some time in construction with Mr. Wayne Wilkins.

He became ill in January 2011 and departed this life July 4, 2011. He leaves behind his life partner, Louisa; three daughters, April, Nathale and C;Leena; stepdaughter; Krystle; stepson-in-law, Tyrone; grandchildren, Johnathan, Elijah, Kaleese and Abraham and lots of friends.

Clyde Harold White, age 73, of Clewiston passed away Monday, July 4, 2011 in Clewiston. He was born January 16, 1938 in Ashburn, Georgia. Harold was a resident of the Glades area for 68 years. He served in the Air Force Reserves as a corpsman. Harold graduated from Florida State University with a Bachelors in Accounting and worked for over forty years as a Certified Public Accountant. He also served as a Hendry County Commissioner for eleven years.

Survivors include his children: Harold Bryant "Hal" White (Michele) of Valrico, Thomas Scott White (Hope) of Clewiston and Suzanne White Martin(Scott) of Clewiston, grandchildren: Michael White, Justin White, Clayton Blair, Chloe White, Jacob Martin, Reed Martin, Hilary Martin and Amelia Martin and brother: Jack White, children and grandchildren of Stuart.

The family received guests on Thursday, July 7, 2011 from 6-8 p.m. at Evangel Assembly of God in Clewiston.
